Divorce:

  • File a complaint against your spouse stating a legal reason to terminate the marriage

Grounds for Divorce:

  • Incompatibility, unless denied by either party.
  • Living separate and apart for one year.
  • Desertion for one year.
  • Either party had a husband or wife living at the time of the marriage from which the divorce is sought.
  • Adultery.
  • Extreme cruelty.
  • Fraudulent contract.
  • Any gross neglect of duty.
  • Habitual drunkenness.
  • Imprisonment in a state or federal correctional institution at the time of filing the complaint.
  • Procurement of a divorce outside this state, by a husband or wife, by virtue of which the party who procured it is released from the obligations of the marriage, while those obligations remain binding upon the other party.
  • Dissolution
  • Both parties agree to dissolve the marriage for no particular reason.
  • Both parties file with the court requesting dissolution.
  • Both parties agree on all aspects involved in the dissolution, such as child custody, child / spousal support, division of assets, division of debts, etc.
  • Annulment
  • Ask the court to declare the marriage invalid due to a defect in the martial contract such as fraud.
  • Legal Separation:
  • Establish legal rights, child support, spousal support, allocate assets, allocate debts, and the like but remain legally married for religious beliefs or for medical insurance benefits.
